Terms of Service & Acceptable Use

These Terms of Service (“Terms”) govern your access to and use of the MADD mobile application, website, and related services (the “Services”) operated by the MADD team (“we”, “us”, or “our”). By creating an account, downloading or using the Services, or clicking to accept these Terms, you agree to be bound by them. If you do not agree, do not use the Services.
These documents are provided for transparency. For binding agreements related to specific bookings, partner terms may also apply.
1. The Services
MADD provides a digital platform to discover aquatic experiences, browse partner offerings in Qatar, manage bookings where integrated, and access related features such as maps and member identification tools. Specific experiences are supplied by independent third-party operators (“Partners”). We facilitate discovery and, where applicable, booking workflows; Partners remain responsible for their services, safety briefings, equipment, schedules, refunds, and compliance with applicable regulations.
2. Eligibility and accounts
You must be of legal age to enter into a binding contract in your jurisdiction (and at least the minimum age required under Qatari law where applicable) to use the Services. You agree to provide accurate registration information and to keep your credentials confidential. You are responsible for all activity under your account unless you notify us promptly of unauthorized use.
3. Acceptable use
You shall not: misuse the Services or attempt to interfere with their normal operation; scrape, harvest, or automate access beyond reasonable personal use without permission; upload malware or harmful code; impersonate others or misrepresent affiliation with MADD or Partners; harass users or staff; circumvent technical limits or payment flows; or use the Services for unlawful, fraudulent, or abusive purposes.
4. Bookings, partners, and payments
When you book through the Services, additional Partner terms, cancellation policies, and pricing rules may apply. Payment processing may be handled by Partners or designated payment processors; we are not liable for delays or failures originating outside our reasonable control. Display errors, availability changes, or force majeure events may affect bookings—Partners’ policies govern refunds and rescheduling unless stated otherwise at checkout.
5. Intellectual property
The Services, including branding, logos, layout, software, and content provided by us (excluding Partner-provided materials), are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, or create derivative works except as expressly permitted.
6. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION. ACTIVITIES INVOLVE INHERENT RISKS; YOU PARTICIPATE AT YOUR OWN RISK SUBJECT TO PARTNER RULES AND SAFETY INSTRUCTIONS.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID TO US DIRECTLY FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR ONE HUNDRED (100) QATARI RIYALS, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.
8. Indemnity
You agree to indemnify and hold harmless MADD and its affiliates, officers, and employees from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Services, your violation of these Terms, or your violation of third-party rights.
9. Suspension and termination
We may suspend or terminate access to the Services if we reasonably believe you breached these Terms, pose a security risk, or are required to do so by law. You may stop using the Services at any time. Provisions that by nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnity) will survive.
10. Governing law and disputes
These Terms are governed by the laws of the State of Qatar, without regard to conflict-of-law principles. Courts located in Qatar shall have exclusive jurisdiction over disputes arising from these Terms or the Services, subject to any mandatory consumer protections in your jurisdiction.
11. Changes to the Terms
We may modify these Terms from time to time. We will post the updated Terms with a revised date. Continued use after changes constitutes acceptance except where additional consent is required by law.
